1. Acceptance
By accessing or using mywater.digital and the application at mywater.digital/app (the "Service"), you agree to these Terms of Use. If you do not agree, do not use the Service.
2. The Service
The Service provides aggregated data, analytics and decision tools relating to the Australian water market. Features and data sources may change, and parts of the Service may be added, modified or discontinued over time.
3. Accounts
You are responsible for the activity that occurs under your account and for keeping your login credentials secure. You must provide accurate information and notify us of any unauthorised use.
4. Acceptable use
- Do not misuse the Service, attempt to disrupt it, or access it by unauthorised means.
- Do not scrape, resell or redistribute data from the Service except as expressly permitted.
- Do not use the Service in breach of any applicable law.
5. Data accuracy
Market, climate and storage data is aggregated from third-party and public sources (including state water registers, the Bureau of Meteorology, the Murray–Darling Basin Authority and water exchanges). It is provided "as is" and "as available". We do not warrant that it is accurate, complete, current or uninterrupted, and indicators, signals and forecasts are estimates that may be wrong. Verify any figure before relying on it.
6. Intellectual property
The Service, including its software, design, analytics and original content, is owned by us or our licensors and is protected by law. Third-party data remains the property of its respective owners.
7. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential loss, or for any loss arising from your reliance on the Service or its data. Nothing in these terms excludes rights that cannot be excluded under the Australian Consumer Law.
8. Termination
We may suspend or terminate access if these terms are breached. You may stop using the Service and close your account at any time.
9. Governing law
These terms are governed by the laws of Australia, and you submit to the non-exclusive jurisdiction of its courts.
10. Changes
We may update these terms from time to time. Continued use after changes take effect constitutes acceptance of the updated terms.
